Warranty Policy

In this Warranty:

SafeGauge means Safe Gauge Pty Ltd (ACN 632 533 343);

You or your means the purchaser or original end-user of the SafeGauge product;

SafeGauge product means a product that was manufactured by SafeGauge, or otherwise supplied to you by SafeGauge or by our Suppliers;

Supplier means the authorised distributor or reseller of the SafeGauge products; and

Operating Quality, in relation to the SafeGauge product, means of acceptable quality, free from manufacturing or parts defects and fit for purpose.

The Australian Competition and Consumer Act (2010) (Australian Consumer Law) as well as other laws in Australia guarantee certain conditions, warranties and undertakings, and give you other legal rights, in relation to the quality and fitness for
purpose of SafeGauge Products sold in Australia.

In Australia, our goods come with guarantees that cannot be excluded under the
Australian Consumer Law. You are entitled to a replacement or refund for a major failure. You are also entitled to have the goods repaired or replaced if the goods fail to be of
acceptable quality and the failure does not amount to a major failure.

Nothing in this Warranty purports to modify or exclude the conditions, warranties and undertakings, and other legal rights, under the Australian Consumer Law or any other applicable law (Consumer Law Rights). This Warranty gives you additional protection
for your SafeGauge product, and outlines the terms by which warranty claims will be accepted or rejected and will detail the required approach to levy warranty claims.

Warranty

  1. SafeGauge warrants that your SafeGauge product is of Operating Quality for a period of 12-months. The commencement date for this warranty period is the day on which the SafeGauge product is invoiced from SafeGauge or its Supplier.

  2. If a warranty claim results in the replacement of the SafeGauge product, the replacement product will adopt the original product’s warranty period and you agree that a new warranty period will not apply to the replacement product.

  3. SafeGauge may agree to provide a different warranty period which will be specified in the contract of sale. For the purposes of this Warranty, any warranty period outlined in a contract of sale will supersede the warranty term defined above, but all other terms in this document remain in effect in full.

Warranty Claims

  1. Subject to the terms of this Warranty, to claim the benefit of this Warranty, you must:
    (i) notify us in writing as soon as you become aware that the SafeGauge products are not of Operating Quality, and in any event, within 30 days of when you become aware of the defect;
    (ii) submit all the relevant details into the “Submit a Warranty Claim” form found here
    and
    (iii) provide any other information reasonably required by us to assess your claim,
    you will then be contacted by a member of the SafeGauge Warranty Team to assist with your claim and advise of next steps.

  2. SafeGauge reserves the right to request further information from you. You must provide troubleshooting and guidance to assist in resolving the issue prior to having the SafeGauge product returned to SafeGauge. Failure to provide such information will result in a warranty claim being declined. SafeGauge’s responsibility under this Warranty is deemed to have been fulfilled if this troubleshooting results in the SafeGauge product operating as intended and without fault. SafeGauge will not accept any further liability unless it can be demonstrated that the product is not of Operating Quality.

  3. The SafeGauge product should not be returned to SafeGauge until a Warranty Claim Number has been provided and you have been directed to return the product to us.

  4. You are responsible for the costs of returning the SafeGauge product to SafeGauge, as instructed by the SafeGauge Warranty Team. SafeGauge will be responsible for the costs of returning the product to you if the warranty claim is accepted, otherwise the costs associated with delivery will be passed to the customer.

Remedy

  • SafeGauge will undertake an assessment of the SafeGauge product to determine if the SafeGauge product is of Operating Quality.

  • If the SafeGauge product is deemed to not be of Operating Quality, SafeGauge (in its sole discretion) will remedy the defect by:

  • repairing the SafeGauge product using new or refurbished materials or;

  • exchanging the faulty SafeGauge product with a new or refurbished product of equal or greater condition.

Exclusions

a. This Warranty does not cover loss caused by:

  • normal wear and tear;

  • damage by fire or water ingression which is not a manufacturing fault;

  • misuse or abuse including the removal of serial numbers;

  • improper use, including the use of non-SafeGauge approved accessories;

  • improper maintenance or failure to maintain;

  • tampering;

  • adverse external conditions such as power surges and dips, thunderstorm activity, acts of God, acts of terrorism, damage
    caused by vermin, or any other act or circumstance beyond SafeGauge’s control;

  • defects not notified to SafeGauge within the warranty period, however, you may also have statutory rights outside of the warranty period.

b. This Warranty does not cover the repair of cosmetic or physical damage.

c. The SafeGauge product does not need to be returned in its original packaging, however, the customer is responsible for ensuring that the SafeGauge product is shipped in suitable packaging. SafeGauge will not accept responsibility for products which are damaged, or lost, in transit.

Additional Services

In addition to the Warranty, SafeGauge offers product support to you for a period of three years from the date on which the SafeGauge product is invoiced from SafeGauge or its Supplier (Product Support Services).

Under the Product Support Services, SafeGauge will assist you in determining if your SafeGauge product is capable of repair.

You acknowledge and agree that any repair is subject to the availability of serviceable parts and third party software, and is subject to you making full payment for any such repair.

The Product Support Services do not in any way seek to replace or extend the SafeGauge warranty as outlined in this Warranty.

General

Governing Law: This Warranty is governed by the laws of New South Wales, Australia.
